IFPI Tries to Stop Magazine Article

CoCo reports:

The German magazine Heise Online has received a cease and desist letter today from the national branch of the International Federation of the Phonographic Industry (IFPI) for publishing an article (German) on circumventions software. The IFPI, representing music corporations worldwide, claims that the article is illegal under the anti-circumvention provision of the German Copyright Law (§ 95a, German), which prohibits to make available, import, disseminate, sale, reproduction and advertisement of anti-circumvention hard- and software.*

Unfortunately, I do not know enough German to understand the original article.

No Patents Today

I’ve been working today so I’ve not been able to follow this closely but it looks like we should thank Poland again.

Patents taken off Fishery Agenda at Poland’s Request Once More

Brussels, 24th January 2005 — The adoption of the Council’s software patent agreement has been postponed once more, as confirmed by the Council’s public information service. Poland was again the country that managed to delay the decision. This means that the Parliament will have time to continue preparing to restart the procedure.

Lagen.nu - Alla Sveriges lagar på webben

Jag har tidigare skrivit om Lagen.nu och även använt mig av den när jag länkat till lagtext. Jag hade dock inte besökt den på ett tag och upptäckte i dag en rad nyheter. Man kan tex numera få information inte bara om nya lagar utan även om förordningar och vägledande domslut från HD, hovrätterna och övriga domstolar genom RSS. Fantastiskt! Finns det inget lämpligt pris man kan dela ut för sådant?

2005-01-19 Software Patents Back on Agriculture & Fishery Meeting Agenda

Brussels, Wednesday 19th Jan 2005 — The EU Software Patent Directive has been or will be scheduled on the agenda of the Agriculture and Fishery Meeting of the 24th of January as an A item, i.e. an item that is to be adopted without a vote. This was announced today by officials of the European Commission and of the EU Council Presidency at various meetings. The entry is not on the official meeting calendar yet.

New Spam Filter Installed

I’m getting tons of comments spam. I have just installed another spam fighting plugin. If you are human and still unable to post comments here, please let me know via e-mail (kj@this.domain.without.the.www.part).

Now I will try to post some spammish comments to this post.

Update: I just found this via Slashdot. Might be worth a try.

Update 2005-01-20: Not one spam comment this morning. I hope that means that the plugin is doing its job and not just that the spammers have taken a day off or something. And, again, please let me know if you have any problems posting comments.

Upphovsrätten och dokumentären

Copyriot tipsar om en intressant artikel i The Globe and Mail: How copyright could be killing culture. Artikeln tar upp de problem dokumentärfilmare allt oftare har med upphovsrätten. Det nu aktuella exemplet är filmen Eyes on the Prize, om medborgarrättsrörelsen i USA. Det arkivmaterial som användes i filmen licensierades för fem år och filmen får därför inte längre visas.

Dessa frågor har man tidigare kunnat läsa om i tex Lawrence Lessigs böcker men det är glädjande att de nu når ut i “vanlig” media.

“Why do you think the History Channel is what it is? Why do you think it’s all World War II documentaries? It’s because it’s public-domain footage. So the history we’re seeing is being skewed towards what’s fallen into public domain,” says filmmaker Robert Stone in the American University study.*

Vad händer när polisen har inte tid för upphovsrätten?

“Polisen har inte tid för fildelare” skriver - Computer Sweden i dagens nummer. CS har talat med en polis och artikelns huvudpoäng är att polisen prioriterar efter straffskalan och att upphovsrättsintrång därför helt enkelt prioriteras bort.

Detta var väl inte helt oväntat och jag tycker även att det är fullt rimligt i de flesta fall. Några andra uttalanden stör mig dock:

Den främsta effekten av de nya reglerna [kriminalisering av nerladdning, se Ds 2003:35] skulle möjligen bli att operatörer är mer villiga att lämna ut uppgifter om personer som inte sköter sig till Antipiratbyrån och liknande organisationer. Tidigare har operatörerna struntat blankt i sådana önskemål, säger Anders Ahlqvist.*

Jag tycker inte att min ISP ska lämna någon som helst information om mig till “Antipiratbyrån och liknande organisationer”. Om det är polisen som frågar är det en annan sak. Då rör det sig om myndighetsutövning. Då finns ett regelverk som ska garantera rättssäkerheten och ge möjlighet att ställa någon till svars för felaktiga beslut.

Överlämnandet av rättskipningen till privata aktörer är en ännu viktigare fråga än upphovsrätten. Vad är nästa steg? Att “Antipiratbyrån och liknande organisationer” tar på sig domstolsrollen och granskar den information de fått ut och sedan låter internetleverantören verkställa “domen” genom att neka den skyldige åtkomst till internet? Varför inte även svartlista de “dömda” hos något branschförening så att de inte kan teckna ett nytt abonemang? Detta skulle vara mycket effektivare än dagens system. Garantier för rättssäkerheten saknas dock helt i ett sådant system.

I just found out about the new Free Software Magazine (via Gnuheter). Issue one looks interesting and some of the articles have been put on my (ever growing…) list of things to read.
